Judge Grants Jack Smith Motion to Dismiss J6 Charges

Well, Donald Trump just got the break he has been waiting for.  

It appears that he will not have to fire Jack Smith after all.  

Smith just made a motion, which was granted, to have the January 6 charges in the case being presided over by Judge Chutkan.  

It’s Over 

Donald Trump was asked numerous times on the campaign trail what he would do about Jack Smith if he won the election.  

Trump repeatedly stated that he would be firing Smith on his first day.  

As I had reported prior, Trump would not have the authority to fire Smith because he was not a presidential appointment.  

His new attorney general, however, would have that power.  

The kicker is that firing Smith would likely be deemed as an abuse of power, and Democrats would likely try to impeach Trump for such an action. 

Smith making this motion saves Trump and the GOP a lot of unnecessary headaches.  

Even though Chutkan appeared to be chomping at the bit to put Trump in prison, she did grant Smith’s motion.  

Chutkan ruled, "The Government has moved to dismiss the Superseding Indictment without prejudice. 

"Defendant does not oppose the Motion…and the court will grant it." 

The other case that Smith has been working on has already been dismissed by Judge Cannon, so I would now expect Smith to drop his appeal of that decision. 

While this is clearly a reason to celebrate, I would be careful about celebrating too much.  

If you notice, the case was dismissed without prejudice, which means charges can still be brought at a later date.  

Quite frankly, I am shocked that Trump’s attorneys did not insist on the case being dismissed with prejudice, which would have blocked future charges.  

So, if Democrats take back the White House in 2028, don’t be surprised to see these charges refiled.
