Judge Says Trump Could ‘Share Responsibility’ for J6 Even If He Did Not Order It

Judge Chutkan continues to show her bias against Trump in the January 6 case being presented by Special Counsel Jack Smith.

Chutkan has never hidden her hatred of Trump, and it is really starting to show in her decisions.

To that point, Judge Chutkan just set the table for how it appears she will get Trump convicted on the presented charges.

You Are Accountable

Smith’s case depends on proving if Trump was responsible for the events that took place that day or not.

Trump’s defense team had a motion struck down by Chutkan this week on attempts for discovery over what they claim are contradictory statements placing blame on Trump.

In her ruling, she explained that even if Trump did not give an order, that does not let him off the hook.

Chutkan wrote, “It is entirely conceivable, for instance, that Defendant could share responsibility for the events of January 6 without such express authorization of rioters’ criminal actions.”

Trump’s team was using statements made in other January 6 cases where prosecuting attorneys admitted they could not directly point a finger at Trump for what took place.

For instance, one prosecutor noted that they could not “identify any remarks made by former President Trump that authorized that illegal conduct.”

There was also a request for documents that were related to allegations of foreign meddling in the 2020 election, to which she responded, “Whether Defendant sought to undermine public confidence in the election to legitimize or otherwise further his criminal conspiracies does not depend on whether other nations also tried to achieve similar results for their own purposes.”

Trump’s team has also tried to have this case dismissed in relation to the recent Fischer v. United States case, to which Smith’s team just replied.

I am not expecting Trump to win that argument, but they actually do have a valid argument, far better than using presidential immunity.

This is a case that I have always stated had teeth and if it ever gets into the courtroom with Chutkan on the bench, I think Trump will have a hard time winning the case.

As I have stated on some of the other cases, I think his best chance for winning will be on appeal because Chutkan, in my opinion, has made it painfully clear she wants to see Trump in prison.
