Judge Chutkan Throws Jack Smith a Lifeline

Special Counsel Jack Smith was on the deck, just about ready to hear himself counted out when Judge Chutkan threw him a lifeline.

The Democrat activist pretending to be a judge announced this week that she is refiring the election interference case against Donald Trump.

This will start with a standings hearing, then we expect her to set a date to get Trump into the courtroom before the end of the year.

Down, Almost Out

While Judge Aileen Cannon has received considerable criticism, Chutkan has avoided criticism even though she suspended Trump’s case months ago.

Chutkan put the case on hold awaiting the outcome of the presidential immunity decision by the Supreme Court.

With the court kicking the case back down to the lower courts, Chutkan took that as a green light to refire the case and give Smith some hope of being able to take Trump out of the picture.

Smith will have to rethink his case after the court narrowed down the obstruction charges filed against the January 6 defendants.

Two of the four counts in Smith’s indictment will be impacted by the decision, but he still does have some life in the case.

Chutkan has given both sides until August 9 to file their standings briefs. She will have the hearing in the final week, during which she is likely to set deadlines for future motions.

We all know she wants Trump in her courtroom, so do not expect any lengthy decisions regarding motions filed by Trump’s defense.

I suspect she will shoot them down almost as quickly as they are filed in an effort to set a trial date before January.

She knows that if Trump wins, once he takes office, he cannot be put on trial, so the goal here will be to get Trump into the courtroom even if it cannot impact the election in November.
