Trump Files Appeal to Overturn Civil Fraud Verdict
The one appeal that I have been waiting to see filed by Trump has finally been filed.
Trump’s legal team has officially filed the appeal for the New York civil fraud case brought by New York Attorney General Letitia James and presided over by Judge Engoron.
From the outset, I have stated that I thought Trump would lose the case and win the appeal, so this one clearly has my interest.
Egregious Ruling
We covered this case to exhaustion when it was happening, so I will not rehash the entire case here, as I am sure most of you reading this know all the facts.
The one thing I would like to point out, however, is that Engoron was clearly biased in the case, having made up his mind before a single witness was called that Trump committed fraud.
Trump lawyer Christopher Kise stated, “Such an outrageous miscarriage of justice is profoundly un-American, and a complete reversal is the only means available to restore public confidence in the integrity of the New York judicial system.”
His attorneys called the arguments made by prosecutors in the case as being “erroneous” and “egregious.”
The defense team further stated that if the verdict was held up, it would give James “limitless power to target anyone she desires, including her self-described political opponents.”
James’ office responded, “We won this case based on the facts and the law, and we are confident we will prevail on appeal.”
I don’t see the decision being completely overturned, but that is surely on the table and would not shock me.
What I think will happen is the penalty will be significantly reduced with a penalty more in line with previous cases.
This verdict was unprecedented on many levels, including the staggering amount of the award given to James’ office.
There is simply no way that I believe this verdict will hold up as is by the time the appeals process finishes playing out.
