Hunter Using Trump Defense to Get Cases Tossed

When I had previously reported on Donald Trump’s case getting tossed by Judge Aileen Cannon, I had stated that if her ruling held up, it would impact other cases.

That has already started, in fact.

Hunter Biden’s defense team has already filed a motion to have his conviction and tax cases dismissed based on the illegal appointment of the special counsel in his case.

If Trump Can Do It…

Hunter’s attorneys argued, “The Attorney General relied upon the exact same authority to appoint the Special Counsel in both the Trump and Biden matters, and both appointments are invalid for the same reason.”

The motion continues, “Given that Congress requires a U.S. Attorney to be nominated by the President and confirmed by the Senate, it makes no sense to assume that Congress would allow the Attorney General to unilaterally appoint someone as Special Counsel with equal or greater power than a U.S. Attorney.

“That is what has been attempted here.”

This issue came before the courts about two decades ago, resulting in Title 28, Chapter VI, Part 600, § 600.1.

That rule outlines the authority of the AG to appoint a special counsel and to this point, it had never been tested.

I tend to lean in the direction that Jack Smith will win his appeal and Hunter Biden will lose his motion due to that rule, but there may be something in here that I am missing that would lead to the decision holding up.

Two quick observations to make here…

If Jack Smith’s appeal wins, get ready for a big push to not only have Cannon removed from the bench in this case, but also a move to have her removed from the bench altogether.

The second point is how ironic it is that Hunter Biden is using an argument to have his cases dismissed that his father excoriated after it was made and that the DOJ is now appealing.

If the ruling does hold, how can Biden and Democrats complain without saying in the same breath that Hunter deserves to be found guilty?

You just can’t make this stuff up.
