Trump Attorneys File Motion to Set Aside Hush-money Verdict

Donald Trump’s attorneys wasted no time after the presidential immunity ruling was handed down to attack the ruling in the hush-money case.

Trump’s attorneys immediately filed a motion to have the verdict set aside based on the Supreme Court's immunity ruling.

Before you get your hopes up, they will not be successful.

Presidential Immunity

To be clear, presidents only have immunity for official presidential acts while they are in office.

This does not cover them before they were in office, during their campaign, or when they leave the White House.

In fact, contrary to what Justice Sotomayor wrote in her dissent, if Trump committed an act while president that clearly did fall under the purview of his office, he would still be held criminally liable.

For instance, Sotomayor stated that Trump could use SEAL Team 6 to take out a political opponent, and he would be immune from prosecution… but that is bullsh**, and she knows it.

Quite frankly, if I were a member of Congress right now, I would be moving to impeach her for making such a ridiculous statement and getting liberals all whipped up over this decision.

Trump’s hush-money payment was made during the 2016 campaign, and even if it had been made when Trump was president, paying someone to honor an NDA is not an act that would fall under the purview of official presidential acts.

I do believe the verdict will be overturned on appeal, or at least any sentence handed down by Merchan reduced, but as far as immunity goes, it is not even relevant.

What this did do, however, was get Bragg’s office to agree to delay sentencing until September, which is after the Republican National Convention.

Before that motion was filed, sentencing was going to be on July 11, just four days before the convention.

In a worst-case scenario, Judge Merchan could have sentenced Trump to jail or house arrest, and he would have been taken off the campaign trail and missed the convention.

The threat of taking Trump off the campaign trail remains, but Trump’s attorneys now have another full month to figure out how to delay that even further.
