SCOTUS says J6 defendants can't be prosecuted under Enron-era statute
The U.S. Supreme Court has issued a new ruling in a case against that impacts former President Donald Trump.
The justices announced that they had decided 6-3 that the government will no longer be able to go after those involved with the Jan. 6 Capitol unrest using an obstruction statute passed during the Enron era.
According to the Supreme Court, the so-called “Enron” obstruction law can no longer be used to prosecute defendants in the manner the U.S. Department of Justice did in the wake of the Capitol demonstrations.
Now, one of the most significant charges Trump is currently facing may end up being thrown out entirely!
It appears this Supreme Court decision will thwart at least some of the charges special counsel Jack Smith has attempted to use to take down Trump.
Smith is likely fuming over the news!
Chief Justice John Roberts wrote for the majority with regard to the ruling.
“To prove a violation of Section 1512(c)(2), the Government must establish that the defendant impaired the availability or integrity for use in an official proceeding of records, documents, objects, or as we earlier explained, other things used in the proceeding, or attempted to do so,” wrote Roberts.
Supreme Court Justice Kentanji Brown also wrote regarding the decision.
“Section 1512(c)(2) is a very broad provision, and admittedly, events like January 6th were not its target. … But statutes often go further than the problem that inspired them, and under the rules of statutory interpretation, we stick to the text anyway,” she noted.
If obstruction charges against Trump are thrown out, it could mean huge things for the former president.
Trump continues to gain momentum every single day, and the failure of these criminal counts would only add to it.
While we do not know the next steps at this time, it is clear that things are looking up for Trump after the high court's decision.
