Schumer Forced to Pull Vote for Biden Judicial Nominee

Senator Chuck Schumer (D-N.Y.) and Joe Biden’s judiciary agenda suffered a setback this week.

Schumer had planned on flooring the vote for Mustafa Kasubhai’s nomination to be a district court judge in Oregon this week.

Schumer was forced to pull the vote due to Democrat absences and stiff resistance from the GOP.

Not Happening

Sens. Dick Durbin (D-IL), John Fetterman (D-PA), Kyrsten Sinema (I-AZ), and Bob Menendez (D-N.J.) decided not to show up for work on Tuesday.

Menendez has actually been absent from chambers for several weeks due to his bribery trial.

Republicans have a united front against Kasubhai, who has been less than impressive during his committee confirmation hearings.

So, the Democrats need everyone in the chamber because they will have some serious challenges getting this nomination across the finish line without a full house.

Their one vote to spare has already confirmed that he will not be voting in favor of the confirmation.

Senator Joe Manchin (I-W.V.) has stated that he will not vote to confirm any nominations that do not enjoy bipartisan support.

That being the case, a full chamber would put the vote at 50-50, with Kamala Harris then having the tiebreaking vote.

Senate Minority Leader Mitch McConnell (R-KY) took a shot at Schumer this week over the quality of Biden’s judiciary nominees.

McConnell stated that Schumer “will dedicate floor time this week to the latest in the Biden administration’s parade of unfit nominations to the federal bench” rather than working on the National Defense Authorization Act.

McConnell added, “Judge Kasubhai’s record and judicial philosophy put him well outside the mainstream.”

Biden’s judiciary nominees have been a complete and utter disgrace, often failing to answer even basic legal questions.

It would appear that Biden is interested in doing nothing more than checking diversity boxes and adding activists to the bench rather than qualified candidates.
