6 Charges Tossed in Georgia RICO Case

Fani Willis was just given another black eye in terms of her having brought RICO charges against Donald Trump and 18 co-defendants.

Judge McAfee has tossed six of the charges in the case, three of them directly against Trump.

It was not so much that the charges were dropped as to the reason that Fani Willis is not facing even more criticism.

It’s a Stain

This is a stain against Willis, and that is putting it mildly.

McAfee just about called her incompetent in announcing that the six charges were going to be dropped from the case.

In his ruling, he stated, “The Court’s concern is less that the State has failed to allege sufficient conduct of the Defendants – in fact it has alleged an abundance.

“However, the lack of detail concerning an essential legal element is, in the undersigned’s opinion, fatal.”

He then added, "As written, these six counts contain all the essential elements of the crimes but fail to allege sufficient detail regarding the nature of their commission, i.e., the underlying felony solicited.

"They do not give the Defendants enough information to prepare their defenses intelligently, as the Defendants could have violated the Constitutions and thus the statute in dozens, if not hundreds, of distinct ways."

Conservative media pounced all over this…

This is clearly a win for Trump, for now, but if you notice the language in McAfee's ruling, prosecutors can re-present the charges as long as they follow his guidelines regarding the specifics of the charges.

McAfee has also extended the statute of limitation by six months to allow for the charges to be re-presented.

McAfee is expected to rule very soon on whether Willis will be disqualified from the case due to her affair with prosecutor Nathan Wade, whom she hired for the case.
