Turley: Supreme Court Downgrades Insurrection Charges to Trespassing

Last week, in one of the more anticipated rulings from the Supreme Court, the court ruled that the law cited to charge many of the January 6 cases does not apply to riots or protests.

This has effectively destroyed the Democrat narrative that the January 6 riot at the Capitol was an insurrection.

This was a crushing blow to Merrick Garland, Joe Biden, and Democrats in general.

Not an Insurrection

I have never hidden the fact that I thought what happened at the Capitol on January 6, 2021, was a disgrace.

Having said that, I have never personally believed it was an insurrection because it was never truly a threat to our government.

It was a protest that turned violent, into a riot, and people clearly got out of hand, but the idea that this was an attempt to overthrow our government is a narrative that was created by Democrats, nothing more.

The Supreme Court’s decision in Fischer vs. U.S. ruled that the “Department of Justice had taken too broad a view of [18 U.S.C.] 1512(c)(2), a law that prohibits the destruction of evidence but was not intended for protests.”

The report further stated, “Unless the defendants could be shown to have interfered with the delivery of documents to Congress, they could not be prosecuted under the statute — as hundreds of people, including former President Donald Trump, have been.”

As Turley noted, this has basically downgraded the insurrection charges to trespassing, which is clearly not as ominous, which is the narrative that Democrats wanted to push regarding the riot.

This decision by the Supreme Court will not only impact dozens of J6 defendants who were charged with insurrection, but it will also impact the indictments that were brought against Donald Trump, many of which will not have to be dropped in Special Counsel Jack Smith’s January 6 case that is being presided over by Judge Chutkan.

This is just a staggering defeat for the Justice Department, but it does right yet another wrong in terms of a bogus narrative that Dems were pitching to the American people.
